Adult Social Care Negotiating Body (ASCNB)
The Department of Health and Social Care’s (DHSC) consultation on establishing Fair Pay Agreements (FPAs) closed in January 2026. We are awaiting the outcome of this consultation and secondary legislation with the timetable for the body to be formally constituted and details on the scope of FPAs. The body, once constituted, is not expected to reach an agreement on pay until 2028/29.
The LGA will keep councils updated on progress of the ASCNB and FPAs.
The Department for Health and Social Care (DHSC) launched a fifteen-week consultation on the creation of the Adult Social Care Negotiating Body (ASCNB). The consultation was launched on 30 September 2025 and closed on 16 January 2026.
In the consultation the DHSC state that:
“A fair pay agreement is an agreement that will set minimum standards for pay and terms and conditions, enforceable by law, as well as improving training opportunities and career progression for the care workforce.
The agreement in England will be reached through negotiation. To do this, we are introducing a form of sectoral collective bargaining in adult social care…. We are doing this at a national level, by setting up the ‘Adult Social Care Negotiating Body’… By establishing this, we will:
- empower workers
- strengthen the role of trade unions in the sector
- ensure staff have the recognition and reward for the important work they do
- boost productivity and improve living standards.”
The proposals to establish the ASCNB are contained within the Employment Rights Bill (ERB) which is anticipated to achieve Royal Assent in early Autumn. The proposals state that the ASCNB itself will be established ‘by autumn 2027’ with the first fair pay agreement expected ‘by April 2028’.
The Fair Pay Agreements (FPA) will cover pay, terms and conditions, training and career progression through a remit set by the Secretary of State.
